Man arrested five times in a month accepts 12-point second-chance deal

Shawn Reed accepts judge's challenge to turn his life around

Arrested last week for the fifth time in a month, for alleged crimes ranging from harassment to assault (of his mother), Shawn Reed appeared in court today and pledged to turn his life around over the next two years.

Speaking to Olympia Municipal Court Judge Scott Ahlf, Reed said "yes" when asked if he was prepared to a  “Stipulated-facts bench trial,” essentially an offer to comply with conditions of a court order. If Reed succeeds in meeting the requirements of the court, “the city will move to dismiss all four of these charges in two years,” according to the judge.

The revolving door of justice stopped today for Reed. Included in the conditions imposed by the court is the offer of specific services to assist him to overcome  drug abuse and mental health challenges.

The conditions agreed to include the following: 

  1. Not commit any criminal law violations.
  2. Notify the court of any address changes.
  3. Provide proof of completion of each of the conditions.
  4. Attend all future court dates and probation appointments.
  5. Pay a $480 probation monitoring fee.
  6. Not possess or consume any alcohol or any item containing alcohol or any drug including marijuana or marijuana derivative unless there is proof of a valid prescription by a physician.
  7. Submit to drug and alcohol testing at the request of probation – breath and urine tests.
  8. Obtain a chemical dependency evaluation and follow through with the treatment that is recommended.
  9. Obtain a mental health evaluation and follow through with the treatment that is recommended.
  10.  Provide Treatment Compliance Reports to the court every 30 days.
  11. Have no contact with the alleged victim per the no-contact order in this case until June 7, 2023.
  12. No possession of a firearm or dangerous weapon.

Reed asked about for clarification of the definition of a dangerous weapon and was advised of the difference between a pocket knife (a dangerous weapon) and a kitchen knife (not a dangerous weapon unless used to threaten another person).

Reed will be on active probation until he completes the requirements.  The case is not closed but is continued.  Reed waives the right to a jury trial in this stipulated-facts bench trial. If he fails to meet the conditions agreed to, the judge advised him that he could be sentenced based on the police report and other evidence already presented to the court.

    And if he violates any of the conditions stipulated in the current order is he liable for restitution of all costs incurred in this action?

    This is the first I’ve heard of a “12 Point Second Chance Deal” for repeat offenders. How long has this been being applied? Has anyone else heard of this? I think it’s a great step personally, but I have to wonder what it’s success rate is or will be.

    I don't know. If he's mentally ill he took a bad deal but probably didn't have anything but a public pretender at best to explain he can't be considered guilty if he doesn't understand why or what he is doing. What happens when he doesn't have the money to pay for this program? Is he then in default and back at square one? Too many questions unanswered for this to sound anything like a good deal. If by society you only mean elitists and yuppy types I guess it might be. For those of us who care about human rights, other people as much as ourselves, . ...I'm just not so sure

    Addiction is a result of trauma and lack of resources. It’s a way to cope. Of course, when people with severe addiction hurt others, that sucks and is not okay. But whatever your perspective is on why people use drugs- publicly shaming someone who is suffering is truly disgraceful. imagine if this was your loved one. Research shows that what truly helps addicts and ultimately empowers them to choose treatment is compassion. Have a good day.
