Lacey mulls letting go of a 40-ft unnamed road

Lacey expressed interest in relinquishing its interest in a 40-foot unnamed right of way (ROW) along Rainer Road during the city’s Transportation Committee meeting on Tuesday, December 6.

City Engineer Aubrey Collier said the ROW does not serve any public purpose anymore as the development of The Links subdivision eliminated the need for a roadway in the location.

Collier said they had already sent out letters to some property owners near the ROW, but they still plan to do additional outreach before they bring a resolution to the city council.

“We haven’t started the formal process yet,” says Collier. “But the first step we wanted was a public outreach to let them know that we are interested in vacating the ROW.”

A vacation occurs when the city gives up its interest in a public ROW. If the city vacates a ROW, the adjacent property owners may get the rights on the vacated area, explained Collier.

Collier said they plan to bring the resolution before the city council in January next year. A public hearing date must be at least 60 days from the resolution date.

If 50% of the property owners object, they would need to file a written protest prior to the hearing, and Lacey would then be prohibited from vacating the ROW.

“I cannot see a negative side to this. I can’t see why they would not want it,” Collier says.
