Olympia man allegedly pepper-sprays neighbor over dog’s death

Posted

An Olympia man was charged with a felony after he allegedly pepper-sprayed his neighbor whom he accused of killing his dog.

A March 8 document from the Thurston County Prosecuting Attorney indicated that Jerry Edmon Fordyce, 72, was charged with unlawful possession of a firearm in the first degree.

Olympia police arrested Fordyce on Mar. 7 after a reported assault on the 1300 block of Fern Street.

Fordyce’s neighbor told police that he heard pounding at his door. He opened it to see the suspect yelling at him then pepper-spraying him in the face.

Police noted that the neighbor’s eyes were “red and watering.” His chest was also said to be red.

Fordyce told police that he sprayed his neighbor because he thought he had killed his dog.

The suspect was booked at the Thurston County Jail for second-degree assault.

Article says "Jerry Edmon Fordyce, 72, was charged with unlawful possession of a firearm in the first degree."

It is perfectly legal to carry/posses pepper spray in Washington state. Jerry used it inappropriately, thus second degree assault, but that doesn't make possession illegal.

Here is the authority for my statement: https://app.leg.wa.gov/rcw/default.aspx?cite=9.91.160

Is there some key fact missing from this story?
